Hoarding is a mental condition that affects roughly 5% of the population in the United States. As a result with the United States being a largely urbanized population, there is a large part of the population living in apartments. Upwards of 35% of the US population rent in apartments and homes. This means if 5% of them are hoarders that means over two million people in apartments are hoarders. As a result of various rules and regulations in many leases there are certain clauses that can affect a person who is hoarding. One of these is often to keep an orderly home.

Hoarding often can create a cluttered situation in a property. This clutter can range from old newspapers to old food items. A wanton amount of miscellaneous items can cause what appears to be a disorderly in the home and therefore would be a consideration to warrant an eviction. The main cause for eviction would be the tenant is causing damage and harm to the property. Also, the property is being used as originally intended, and this is being a residence for the individual and not their items. Another way that the hoarder can be evicted is with endangerment.

Many of the people that are renters live in large apartment buildings and complexes. This can create an issue with one of the tenants being a hoarder. The hoarder could potentially hoard things that are not healthy for individuals who are living around the area. These health hazards could potentially spread diseases or other ailments to neighbors of the hoarder. Hence why it would be necessary for the hoarder to be evicted justifiably.

There are certain rules that protect the individual from being evicted. However, in the cases of extreme clutter or hoarding the rights of the individual are superseded by the rights of the majority. In this case the hoarder has no right endangering the rights of the many to live a full and healthy life.
